(Patent Infringement)
CLIENT distributes paper filter cartridges and is a direct competitor of PLAINTIFF. CLIENT was founded by former Harmsco employees. PLAINTIFF sued CLIENT, charging willful patent infringement, and seeking damages in excess of $200,000.00. We denied infringement, alleging both non-infringement and invalidity. Immediate evaluations of the potentially infringing product line were instituted and prior art studies undertaken through industry contacts and experts. Potentially invalidating prior art was identified and expert testimony was secured. In light of the small amount in controversy, depositions were delayed pending early mediation. Early identification of invalidating prior art allowed the matter to settle at mediation at a low cost to the client.
