CLIENT, an engineering and manufacturing facility, private labels a number of different goods, including photo processing units. CLIENT was approached by, and assisted, PLAINTIFF in the development of an improved photo processing unit. Upon termination of the collaborative effort, PLAINTIFF applied for and was granted a U.S. Patent and sued CLIENT for patent infringement. Early patent claim analysis and evaluation of CLIENT’S contribution towards the patentable technology led to counterclaims for non-infringement and invalidity. The court entered judgment for CLIENT shortly following oral argument on Motion for Summary Judgment.
